Về việc nhà cầm quyền Việt Nam yêu cầu bắt giữ và dẫn độ luật sư nhân quyền Nguyễn Văn Đài từ CHLB Đức

Tôi, luật sư nhân quyền Nguyễn Văn Đài, hiện đang tị nạn chính trị hợp pháp tại Cộng hòa Liên bang Đức, chính thức lên tiếng phản đối mạnh mẽ yêu cầu vô lý và mang tính đàn áp chính trị của nhà cầm quyền Cộng hòa Xã hội Chủ nghĩa Việt Nam.
Theo thông báo từ phía cơ quan chức năng Đức, nhà cầm quyền Việt Nam đã gửi yêu cầu tới Bộ Tư pháp CHLB Đức đề nghị bắt giữ tôi, sau đó tiến hành các thủ tục nhằm dẫn độ tôi về Việt Nam. Lý do mà phía Việt Nam đưa ra là tôi đã có các hoạt động trên mạng xã hội nhằm thay đổi chế độ chính trị và thay đổi chính phủ tại Việt Nam.
Tôi khẳng định:
1. Các hoạt động của tôi hoàn toàn là những hoạt động chính trị ôn hòa, thực hiện quyền tự do ngôn luận, tự do chính kiến và tự do vận động dân chủ – những quyền cơ bản được bảo đảm bởi Hiến chương Liên Hợp Quốc, Công ước Quốc tế về các Quyền Dân sự và Chính trị (ICCPR) cũng như Hiến pháp của nhiều quốc gia dân chủ.
2. Việc nhà cầm quyền Việt Nam tìm cách hình sự hóa hoạt động bày tỏ chính kiến ôn hòa cho thấy bản chất đàn áp và không dung thứ đối lập chính trị của chế độ này.
3. Không có bất kỳ quốc gia pháp quyền và dân chủ nào trên thế giới bắt giữ một người hoạt động chính trị đối lập chỉ vì họ thực hiện quyền tự do biểu đạt, để dẫn độ họ về quốc gia mà họ là công dân, đặc biệt khi quốc gia đó có hồ sơ vi phạm nhân quyền nghiêm trọng và có tiền sử đàn áp những tiếng nói bất đồng.
Tôi ghi nhận và trân trọng quyết định của Bộ Tư pháp và Cảnh sát Liên bang Đức khi khẳng định sẽ không thực hiện yêu cầu của phía Việt Nam, đồng thời tăng cường các biện pháp bảo vệ an toàn cho tôi. Quyết định này thể hiện cam kết nhất quán của CHLB Đức đối với nguyên tắc pháp quyền, quyền con người và nghĩa vụ bảo vệ người tị nạn chính trị theo Công ước Geneva năm 1951.
Yêu cầu của nhà cầm quyền Việt Nam không chỉ phi lý về mặt pháp lý mà còn mang tính chất lạm dụng cơ chế hợp tác tư pháp quốc tế nhằm truy bức người bất đồng chính kiến vượt ra ngoài lãnh thổ quốc gia. Đây là một tiền lệ nguy hiểm, đe dọa trực tiếp đến an toàn của những người tị nạn chính trị trên toàn thế giới.
Tôi kêu gọi:
• Chính phủ Đức và Liên minh Châu Âu tiếp tục giám sát chặt chẽ các hành vi đàn áp xuyên quốc gia của nhà cầm quyền Việt Nam.
• Các tổ chức nhân quyền quốc tế lên tiếng trước việc lạm dụng các cơ chế tư pháp quốc tế để đàn áp chính trị.
• Cộng đồng quốc tế gây áp lực để Việt Nam tôn trọng các cam kết quốc tế về quyền con người mà họ đã ký kết.
Tôi sẽ tiếp tục con đường đấu tranh ôn hòa cho tự do, dân chủ và nhân quyền cho Việt Nam bằng các phương thức hợp pháp và phù hợp với luật pháp quốc tế.
Mọi nỗ lực nhằm bịt miệng những tiếng nói đối lập chỉ càng cho thấy sự bất an và thiếu chính danh của một chế độ không chấp nhận tự do chính trị.

Regarding the Vietnamese Government’s Request for the Arrest and Extradition of Human Rights Lawyer Nguyen Van Dai from the Federal Republic of Germany
Berlin, 11 February 2026
I, human rights lawyer Nguyen Van Dai, currently residing in the Federal Republic of Germany under lawful political asylum status, hereby strongly protest the unreasonable and politically motivated request made by the government of the Socialist Republic of Vietnam to the German authorities seeking my arrest and subsequent extradition to Vietnam.
According to information officially conveyed to me by German law enforcement authorities on 11 February 2026, the Vietnamese government submitted a request to the Federal Ministry of Justice of Germany asking for my arrest and extradition. The stated grounds for this request are allegations that I have engaged in online activities advocating for political change and governmental reform in Vietnam.
I categorically affirm the following:
1. My activities consist solely of peaceful political expression and advocacy for democracy, human rights, and the rule of law. These activities fall squarely within the fundamental rights to freedom of expression, opinion, and political participation as guaranteed under the Universal Declaration of Human Rights, the International Covenant on Civil and Political Rights (ICCPR)—to which Vietnam is a State Party—and the constitutional frameworks of democratic nations.
2. The attempt by the Vietnamese authorities to criminalize peaceful expression underscores the ongoing suppression of dissent and the systematic denial of political freedoms in Vietnam.
3. No democratic state governed by the rule of law arrests and extradites a political dissident solely for exercising peaceful political speech—particularly when the requesting state has a well-documented record of arbitrary detention, unfair trials, and persecution of government critics.
I express my sincere appreciation to the Federal Ministry of Justice and the German Federal Police for their clear decision not to act upon Vietnam’s request and for strengthening protective measures to ensure my safety. This decision reflects Germany’s firm commitment to the rule of law, international human rights obligations, and the protection of refugees under the 1951 Geneva Convention Relating to the Status of Refugees.
The Vietnamese government’s request represents not only a legal absurdity but also a form of transnational repression—an attempt to extend political persecution beyond its borders by misusing international judicial cooperation mechanisms. Such actions set a dangerous precedent and pose a serious threat to political refugees worldwide.
I respectfully call upon:
• The Government of Germany and the European Union to remain vigilant regarding acts of transnational repression by the Vietnamese authorities.
• International human rights organizations to monitor and publicly address the misuse of legal instruments for political persecution.
• The international community to urge Vietnam to comply with its international human rights obligations and to cease criminalizing peaceful political dissent.
I will continue my peaceful and lawful advocacy for democracy, human rights, and the rule of law for Vietnam in accordance with international law and democratic principles.
Attempts to silence dissenting voices abroad only further expose the insecurity and lack of legitimacy of a system that refuses to tolerate political pluralism.
